1. Agreement & Acceptance

This agreement is between you (the 'User') and Grasmere Gingerbread Limited ('we', 'us', 'our'), Church Cottage, Grasmere, Cumbria LA22 9SW, registered in England & Wales (Company No. 04211868) ('the Website'). By using the Website, you agree to these Terms. If you do not agree, you should stop using the Website immediately.

Nothing on the Website is a contractual offer capable of acceptance. Your order is an offer to buy; a binding contract is only formed once we send you an order confirmation email confirming your order has been accepted and dispatched.

2. Definitions

Term	Meaning
Account	The personal information and credentials used to access the Website's services.
Goods	Products we advertise or sell through the Website.
Carrier	Any third party transporting Goods from us to you.
Content	Text, images, video, data and other material on the Website.
User / You	Anyone using the Website who isn't acting as our employee.

3. Who Can Use This Website

Under-18s should only use this Website with adult supervision, and any payment must be authorised by an adult. These Terms apply equally to consumers and to business customers buying in the course of business.

4. Your Account

• Keep your login details confidential; we are not liable for losses caused by shared account details.
• If you believe your account has been accessed without your consent, contact us immediately on +44 (0)15394 35428 or mailorder@grasmeregingerbread.co.uk — purchases can only be cancelled before dispatch.
• Either party can close an account. If we close yours, we will tell you why by email, except where we are entitled not to.

5. Goods, Pricing & Availability

We take reasonable care to describe Goods accurately; minor variations from images/descriptions do not affect your statutory rights for faulty or misdescribed Goods (see Section 7).

Prices shown at checkout include VAT (Grasmere Gingerbread is zero-rated; VAT No. GB 190 1492 16) and any delivery charge before you complete your purchase — in line with the Digital Markets, Competition and Consumers Act 2024, we do not add mandatory charges after you've committed to buy.

We may change prices, offers or availability at any time before you complete your order.

6. Orders & Delivery

We aim to dispatch and deliver next-day within the UK, but delays outside our or our courier's reasonable control can occur; we do not refund solely because a next-day target was missed. Tracking your parcel is your responsibility.

Full delivery pricing, timescales, and international shipping terms — including current restrictions on the USA, Canada and certain EU destinations — are set out in our Delivery & Returns page, which forms part of these Terms.

6.1 International Deliveries

For Goods delivered outside of the UK, import duties and taxes may be incurred once your Goods reach their destination. We are not responsible for these charges and we undertake to make no calculations or estimates in this regard.

If you are buying for international delivery, you are advised to contact your local customs authorities for further details on costs and procedures. As the purchaser of the Goods, you will also be the importer of record and as such should ensure that your purchase is in full compliance with the laws of the country into which the Goods are being imported.

Please be aware that Goods may be inspected on arrival at port for customs purposes and that we cannot guarantee that the packaging of your Goods will be free of signs of tampering.

Please also be aware that United Kingdom consumer protection laws may not apply.

7. Returns, Refunds & Cancellation

We take care to ensure Goods arrive fresh, correct and undamaged. Your rights differ depending on whether you have bought perishable or non-perishable Goods.

7.1 Perishable Goods (food items — the products we are best known for)

If your order is wrong, damaged in transit, or faulty, contact us within 1 calendar day of delivery on +44 (0)15394 35428 or mailorder@grasmeregingerbread.co.uk — given the short shelf life, prompt reporting lets us put things right while a replacement can still reach you fresh. You'll be offered a replacement or full refund; we cover all return/re-shipment costs, and refunds are issued within 1 working day.

Because perishable Goods deteriorate rapidly, the 14-day statutory change-of-mind right described below does not apply to them (Consumer Contracts Regulations 2013, reg. 28(3)(b)). This doesn't affect your right to a replacement or refund for Goods that are faulty, damaged or wrongly supplied.

7.2 Non-Perishable Goods (e.g. merchandise, tins, non-food gifts)

• Faulty or misdescribed: contact us as above; you're entitled to a replacement or refund under the Consumer Rights Act 2015, and we cover return costs.
• Change of mind: you have a statutory 14-day cooling-off period from delivery (or from the final instalment, if delivered in parts) to tell us you want to cancel, plus a further 14 days to return the Goods. Refunds are issued within 14 days of us being notified and include standard delivery charges. You pay return postage.
• Exceptions to the change-of-mind right: personalised or made-to-order Goods; Goods sealed for health/hygiene reasons once unsealed; Goods inseparably mixed with other items after delivery; and sealed items where the seal is broken. Handling Goods to check them (as you would in a shop) doesn't forfeit this right — but use beyond that may reduce any refund.

8. Intellectual Property

All content on the Website — text, graphics, logos, images, page layout, underlying code — belongs to us, our affiliates, or relevant third parties, and is protected by UK and international IP law.

You may not copy, reproduce, distribute or reuse it without our written permission, except where permitted under the 'fair dealing' exceptions in the Copyright, Designs and Patents Act 1988.

Product images and descriptions supplied by manufacturers remain the property of those manufacturers or their licensors.

9. Links To and From This Website

Links to other websites do not imply our endorsement, and we are not responsible for their content.

You may link to our homepage without permission; deep-linking to specific pages requires our written consent — contact technical@grasmeregingerbread.co.uk to find out more.

10. Acceptable Use

When contacting us or using any communication feature on the Website, you must not:

• Use obscene, abusive, threatening, defamatory or discriminatory language;
• Post unlawful content or content intended to incite violence;
• Impersonate any person, or send unsolicited bulk messages ('spam');
• Breach these Terms or any applicable law.

We may monitor and retain communications sent to us or via the Website's systems.

11. Privacy & Cookies

Use of the Website is also governed by our Privacy Policy & Cookies notice, which explains what personal data we collect, how we use it, our use of cookies, and your rights under UK GDPR, the Data Protection Act 2018 and the Data (Use and Access) Act 2025.

That notice is incorporated into these Terms by reference — please read it before using the Website.

12. Liability & Disclaimers

The Website is provided 'as is' and 'as available'. We do not guarantee it will be uninterrupted, error-free, secure, or fit for any particular purpose, and nothing on it constitutes advice to be relied upon. To the fullest extent the law allows, we exclude liability for indirect or consequential loss arising from your use of the Website.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence or fraud, or for incorrect delivery of Goods or incorrect information on the Website, where the law doesn't allow such exclusion.

13. General

• If any part of these Terms is found unenforceable, the rest remains in effect.
• A failure by either party to enforce a right is not a waiver of that right.
• These Terms do not create any rights for anyone who is not a party to them.
• We may update the Website or these Terms at any time; continued use after a change means you accept it. Where a change is legally required, it will also apply to orders already placed.

14. Governing Law

These Terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute.
